Pre-sentencing

Interview with Ed

JM: Tell us about the pre-sentencing process:
Ed: The pre-sentencing process for me was long and drawn out, I spent most of it out on bail. It lasted about 8 months. I was originally charged with first degree assault in April 2002 and spent a few days in a juvenile facility (was still a juvenile at the time).

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Ed: As I mentioned before I was arrested for 1st degree assault. I had stabbed a school classmate during a fight while partying. I don't remember much about the actual crime because I was so drunk, the next day I was sent to Fairbanks from the village. I was originally sent to Fairbanks Youth Facility. After sentencing I was remanded to Fairbanks Correctional Center because I was now over 18.

JM: What was court like? Please give as many details as you recall.
Ed: Court was a long and very drawn out process. I think it was mostly because of the seriousness of the charge, 1st degree assault convictions can result in sentences up to 5 to 7 years. There were a lot of hearings and calendar calls which were new to me because this was the first time I was charged with such a serious crime. There was a lot of anxiety in the process from my perspective, I had know idea what would happen.

JM: What were your original charges? What did you end up being convicted of?
Ed: Original charge was 1st degree assault. I eventually plead no-contest to 2nd degree assault.
