Pre-sentencing

Interview with Tom and Joe

JM: Tell us about the pre-sentencing process:
Tom: There was no pre-sentencing process
Joe: i had to wait in jail from july 25 till september 9 to get sentenced and in the end i had to serve an extra month because someone made a mistake and sentenced me to 120 days instead of my prior 90 days so i got out november 27 2011

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Tom: no I was stoped in a traffic stop
Joe: i was charged with battery in the second degree because i hit a guy wit a golf club....the incident started over this guy arguing with my mom over my dog barking and then he pushed her so out of anger i grabbed the golf club and i blacked out after that. the officers tried for me not to go to jail but since i used a weapon they took me in.

JM: What was court like? Please give as many details as you recall.
Tom: I did not appear in court
Joe: Judgr Green was trying to help me out and give me 60 days in jail but the prosecuting attorney didnt want to settle for anything under 120 days. if i didnt take that offer it was goin to go to trial and if i lost i would have done my probation time in prison wich would have been a total of 5 yrs.

JM: What were your original charges? What did you end up being convicted of?
Joe: battery 2nd degree and failure to appear
