Pre-sentencing

Interview with Tom and Barbara

JM: Tell us about the pre-sentencing process:
Tom: I was already in custody in Tracy, California at DVI State Prison for an offense in Yuba City, Ca. I had a case pending in Contra Costa County. I filed the paperwork to get transferred and was sent to the main detention facility in Martinez, Ca. I was there for 13 months fighting my case. I accepted a plea bargain for 4 years that ran concurrent with the 3 years I already received in Sutter County. I had a decent stay while in Contra Costa as I was a trustee on the worker module. That is by far the best place to be within all 3 of the jails in Contra Costa.
Barbara: It took 5 weeks after conviction to be sentenced. The housing and procedures were the same as before trial and convictions. Stayed in general population with other inmates who were in processing, awaiting trial and waiting to go to prison. Had a probation officer come to jail to interview with other inmates around for the probation/pre-sentencing report

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Tom: No as I was already incarcerated and it was pretty obvious I was guilty I had no interviews or police contact until I went to court.
Barbara: While on a trip, I had a previously scheduled family law court case scheduled, so I returned to the court and turned myself in. Apparently the police had gone to my home several times while I was on my trip to arrest me. There was an in state warrant for my arrest (I had been out of state)

JM: What was court like? Please give as many details as you recall.
Tom: I had numerous court appearances and all of them were tolerable. I knew already what the district attorney was offering in regards to the plea bargain and it was a very fair offer so that really reduced my stress level. The court police as well as the judge and district attorney were all very professional and spoke with respect. As far as court goes it was a decent experience overall.
Barbara: The court house was older, it was kind of dirty, there were way too many cases and inmates waiting to see judge. The holding cells were usually standing room only and had a tv that was left on IF the inmates behaved and didnt fight or argue and kept noise to a minimum

JM: What were your original charges? What did you end up being convicted of?
Barbara: Deprivation of custody. Charged and convicted
