Pre-sentencing

Interview with Ryan and Kathryn

JM: Tell us about the pre-sentencing process:
Ryan: I hired a lawyer and had to plead down the initial charges. The prosecutor wanted to sentance me to prison for 3 years, however we made a plea deal which involved me only spending 120 days in Jail, after that I had to go to and complete an Intensive Outpatient Program and I had probation for 2 years.
Kathryn: was pre-sentenced in front of judge. I knew my sentence

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Ryan: I was in a car accident while under the influence. The police came to the site of the accident with ambulances. I was taken first the hospital and from there straight to jail. While I was in the hospital they took blood and urine samples from me which is how they justified taking me straight to jail.
Kathryn: No

JM: What was court like? Please give as many details as you recall.
Ryan: Court seemed like it was just a formality. It was all about the prosecutor trying to keep his convited rate high and my lawyer trying to cut the best "deal" he could for me. It was as if I was already determined to be guilty and it was all a matter of what my penalty would be.

JM: What were your original charges? What did you end up being convicted of?
Ryan: Driving under the influence careless driving failure to maintain lane
Kathryn: DUI, Driving while Suspended
