Pre-sentencing

Interview with Tim

JM: Tell us about the pre-sentencing process:
Tim: After the first arrest, I was in county for just a day and bonded out. Then when my court appearance came up it was raining and I couldn't get anyone to drive me so I missed that and they charged me with failure to appear. When I was arrested the second time, I was in the county for a weekend before going in front of the judge.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Tim: I was arrested for assault right at the time it happened and then I was arrested again for failure to appear. So it was two times.

JM: What was court like? Please give as many details as you recall.
Tim: I though I was going to the pen. This was a severe assault so I knew I was in it for sure. I had a court appointed lawyer who told me to just plead no contest. I did that and they reduced the charges.

JM: What were your original charges? What did you end up being convicted of?
Tim: The original charge was felony assault and failur to appear. That got dropped down to attery misdermeanor assault and failure to appear.
