Pre-sentencing

Interview with Carol

JM: Tell us about the pre-sentencing process:
Carol: I was in population within 30 hours. Cherokee co has a bond hearing within 72 hours. They get you at 4am and you have to sit in a holding cell until court starts. They took everyone in to see the judge (approx 20 people) we all stand and the judge calls everyone alphabetical order.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Carol: No, I was pulled over from leaving a gas station. The clerk at the gas station had called and said i was driving on the wrong side. They gave me a field sobriety test and had me blow into a tube (it just checked for the presence of alcohol) not an actual breathalizer. I was then taken to the nearest fire station where they drew blood.

JM: What was court like? Please give as many details as you recall.
Carol: I was in dui court.I had to first sign alot of paperwork from my attorney to be accepted to dui court. I was the last person that was seen by the dui judge so it was just the judge, about 3 clerks, 2 deputies. While I was standing there they told me what my bac was. I was pretty upset it was very nerve racking. Its hard to make sense when people are talking to you because you pretty much go in on no sleep.

JM: What were your original charges? What did you end up being convicted of?
Carol: DUI (3rd) Failure to maintain lane.
