Pre-sentencing

Interview with Rhett and Stewart

JM: Tell us about the pre-sentencing process:
Rhett: I spent about eight hours the first time and 14 hours the second time. My parents bailed me out and got two lawyers and they took it from there.
Stewart: Started with a bad friendship with someone and progressed into more and more, towards the end things were getting heated and between me and the other person we had an exchange of words and I made some very hateful remarks and was told to leave them alone several times before.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Rhett: I was pulled over for following too close. When the cops came up I rolled down the window and they smelled the marijuana. That let them do a search of the car and they found other drugs I had. I was taken to the hospital for a blood test and then right to county jail. While I was out on probation, I was pulled over again and was arrested for a 2nd DUI.
Stewart: I was issued a 50b and was arrested for my charge, during that same day the I was given prayer for judgment. After the court date I was ordered to a year and a half of supervised probation and 30 day suspended sentence. With out a job and too much on my mind I decided to serve my 30 days instead of jumping though all the hoops.

JM: What was court like? Please give as many details as you recall.
Rhett: My main concern was being a convicted as felon. It was my first arrest so I had the option to complete probation and do all the requirements and you can get your record expunged. I didn't want the stigma of being a felon. I didn't end up going to jury trial but made a plea bargain arrangement.
Stewart: I decided to represent myself and the DA was completely heart set on nailing me to the cross. I couldn't even get a word in edge wise and considering the plaintiff was a female and was lying and crying at the same time the judge obviously wanted to grill me just as well.

JM: What were your original charges? What did you end up being convicted of?
Rhett: Drug possesion of a controlled substance, DUI and reckless driving. That was basically what I was convicted of drug poss dui and traicifced.
Stewart: I was told this would be confidential and I do not feel comfortable discussing my criminal record but if you must know misdemonor cyber stalking
