JM: Tell us about the pre-sentencing process: Dave: When I got arrested I was put right in jail and
stayed there until my trial and then went right
back once they passed the sentance. I had a
lawyer that I paid for myself. They offered my
plea bargains which I ultimately took but I was
in jail the whole time. Julian: I was arrested when I got pulled over and immediately taken to jail.
I
couldn't bail out and waited there for a week until i had a court
date.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Dave: I was 18 at the time and was with a couple of
friend riding around. We saw some people we
didn't like so we went and stopped off at a
friends house and got a gun. Then we went back
out and when we saw them again, I just got out
and started shooting. Then somebody called the
cops. The cops found us and we got into a chase
and a run then we got caught up. Julian: No- I was pulled over for DUI and also had a warrant for battery.
JM: What was court like? Please give as many details as you recall. Dave: I was scared. I didn't know what to expect and
didn't know if I was going to have to spend the
rest of my life in jail or not. Julian: Noisy, scary, cold. You don't know what is going on. You are also
cuffed and shackled for all of it.
JM: What were your original charges? What did you end up being convicted of? Dave: Organized criminal gang activity which is a 1st
degree felony, possession of a deadly weapon,
aggravated assault. The gun charged was dropped
because they messed up the paperwork. Julian: DUI, resisting arrest, battery.
