Pre-sentencing

Interview with Austin

JM: Tell us about the pre-sentencing process:
Austin: I was arrested and sent to jail then released on bail. Spent about 45 days waiting for my bail hearing.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Austin: I was arrested for DUI and possession of a controlled substance. Bascially I got pulled over and I guess that had suspicions about my illegal use. So I was given a field sobriety test and a breathalzyer which I passed. But they still arrested me, took me right to a hospital where thy gave me a blood test and sent me to jail.

JM: What was court like? Please give as many details as you recall.
Austin: I was pretty scared. You're not given a public defender for a bail hearing so it's up to you to say what you need to say to get a lower bail.

JM: What were your original charges? What did you end up being convicted of?
Austin: 4th degree DUI and 5th degree possession of illegal narcotic.
