JM: Tell us about the pre-sentencing process: Alan: I was arrested for Drunk Driving at 3am. I had to
wait until 9am to see a judge. The judge told me
of my charges and the amount of my bail and
various conditions of release. I had to get a
lawyer and I entered a plea of Nolo Contendere.
Martin: the pre sentaceing process takes three months if
you are incarcerated up to a year if you are not
in custudy during intial arrest you are taken to
city jail then county where you arebooked and left
in a holing tank for up to a week its only
supposed to be twenty four to fourty eight hours
but cops do what they want
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Alan: I was arrested during a routine traffic stop while
driving home late/early one night after a party.
The police stopped me because my the head light in
my car was burned out on the drivers side. and
they said I was swerving and that I looked
intoxicated and smelled of alcohol. Martin: no i was arrested in the commision of a crime it was
the stupidist thing i was walking though an
apartment complex and took a golf cart to the other
end of the building matinence chased me down and the
police got me for operrating without owners concent
and paraphenilia
JM: What was court like? Please give as many details as you recall. Alan: I showed up to court with my lawyer. The judge
called my full name. I stood in front of the
judge with my lawyer. The judge read my charges. I
entered a plea of Nolo Contendere. The judge
accepted my charges and sentenced me to 90 Days
Deferred Judgment. The judge asked me if I
understood my sentence to which I answered, "Yes
sir." I signed some paperwork and was free to go.
Martin: i remember it being fair and within a timely manor i
feel that sometimes court is just a money scam that
destroys poor people but when i was arrested i felt
the court was only about serveing justice and they
were fair and just with the sentance i was satisfied
JM: What were your original charges? What did you end up being convicted of? Alan: Original Charges: OWI (operating while
intoxicated)First offense.
