Pre-sentencing

Interview with Diana

JM: Tell us about the pre-sentencing process:
Diana: I was arrested January 21, 2012. It took a month for a bail hearing and another 6 months before I was indicted. Almost a year after my arrest I was offered a plea which I accepted not because I was guilty, but based on the fact I was told it would be another year or two before my trial would begin.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Diana: Yes police did stop by my house for questioning 6 months prior to my arrest and then again 3 months prior to my arrest they asked that I come to the station for questioning. On January 21, 2012 they arrested me at my home and took me to the county jail for processing.

JM: What was court like? Please give as many details as you recall.
Diana: At my initial court date, my bond hearing, the prosecutions witnesses both lied under oath. I wasn't able to prove it with the documentation that I had in my possession because I was not allowed to bring the paper work with me to court. At the sentencing court date for my plea bargaining the paperwork was messed up which delayed my release.

JM: What were your original charges? What did you end up being convicted of?
Diana: My original charges were Intentional Child abuse, however I was convicted of Felony Child Abuse.
