JM: Tell us about the pre-sentencing process: Brad: i spent 83 days in county jail until i was
sentenced to 1-2 years in state prison.i was
sentenced on june 1,2011.i was picked up and
transferred to sci pittsburgh on june 7,2011 to
begin the process of being screened to be sent to
my "home prison" which was sci Fayette.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Brad: i was on probation for 6 years due to having
comitted multiple counts of theft by deception.on
march 11,2011 i took some narcotic pain killers i
had bought off the street.the next morning my
probation officer called me at my home and stated
someone had called her and said i was taking
illegal drugs and i was to come to her office to
take a urine test.upon arrival at the probation
office i gave a urine sample and it tested
positive for opiates.then i was arrested for my
seventh probation violation and put in lawrence
county jail to await a court hearing to determine
how much jail time i was going to get for my
revocation.
JM: What was court like? Please give as many details as you recall. Brad: at my revocation hearing i had a public
defender.when my case was called i sat at the
defendants table with him and across from us my
probation officer sat with the assistant district
attorney.as the hearing proceeded my p.o. stated
the facts of why she had revocating my
probation.i had six probation cases and each for
1 year adding up to a total of 6 years of
probation.she violated on each case and gave the
recomendation that i be sent to state prison
because it was my seventh time violating the
terms of my probation and the judge agreed with
her because that is usually the case when
someones p.o. give a recommendation.almost always
the judge will do what the probation officer
wants.
JM: What were your original charges? What did you end up being convicted of? Brad: my original charges were 6 counts of theft by
deception.i was convicted on all counts and given
6 years probation originally.
