Pre-sentencing

Interview with Mitch

JM: Tell us about the pre-sentencing process:
Mitch: I was on probation for a traffic stop during which I was arrested for marijuana possession the previous year. While on probation I was given a drug test and failed it for marijuana. I was charged with probation violation which is what I was in jail for. They sentenced me to 6 months.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Mitch: No I did not have the police stop by for questioning at my house. I failed my drug test at my probation meeting and when the officer saw that I failed I was arrested immediately and taken straight to jail within 20 minutes. I bonded out that day and went to court the next month for sentencing.

JM: What was court like? Please give as many details as you recall.
Mitch: I was told to come to court a half hour early so I could talk to the probation officer about possibly extending my probation. I showed up and she would never speak to me. I wasn't even to the podium yet before they had finished reading my charges. I went straight to jail from there.

JM: What were your original charges? What did you end up being convicted of?
Mitch: Probation violation is what I was charged and convicted of.
