Interview with Dave and Miss

JM: Tell us about the pre-sentencing process:
Dave: I was at a party. I was 20. Me and this girl started doing stuff together and later on she accused me of forcing myself on her (oral sex) because her boyfriend ended up being there. She ran out of the room and said I forced her. I went to jail that night becaue I lied about my name. I was under 21 and drunk, so I lied because I thought the police were there because of that. Lying about my name blew my credibility. I was put in jail Saturday night and then I ended up getting out Monday after I was arraigned. I bailed out. I had a $50,000 bond- lowered to about $700 cash. I had to wait for the magistrate to set bail for me. She wasn't going to give me a bail, I'm not sure why her mind changed. The only evidence they really had was the word of the girl and the fact that I lied about my name.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Dave: The police wouldn't tell me what I was being arrested for until we were almost to the jail. When I got out, the bail bondsman just wanted me to plead guilty, and told me to tell them I would never do it again, I needed help, etc. That was pretty traumatic for him to say that to me. It was very inappropriate.

JM: What was court like? Please give as many details as you recall.
Dave: We got the best lawyer we could get. 8 months after I was arrested we went to court and we were planning to go to trial. We never got to trial because I took a plea. I took a plea and got an assault charge.
Miss: The judge was ok. I think he was relatively decent and fair , and was notoverly mean.

JM: What were your original charges? What did you end up being convicted of?
Dave: Original charges were (5) indecent exposure, intent to penetrate, can't remember the specifics of the other 3. One was for something to do with oral sex. It started out with 2, when they took me to jail for the weekend but once I got the paperwork I had five. Plead guilty of high court misdemeanor assault and HYDA status (can give it to you if you are up to 25) for gross indecency (HYDA is not a public record)
