JM: Tell us about the pre-sentencing process: Dan: the pre-sentencing process was long because they
took me to jail and then i had to go to court the
next day then the judge wants there so i had 2 more
court appearances it was more of a waste of my time
in way that i had went there Hugh: You are in the booking area of the jail
and get on a video phone to complete
the interview. They ask you questions
like where you are living if you are
working and any other questions that
would propose any options for when you
go to your pre trial and sentencing Wendy: I had a family member post bail for me, I took
a plea deal to avoid court and I was never
placed on probation, just had to pay a fine for
disorderly conduct in the privacy of my own
home. the whole entire process was very very
long and exhausting.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Dan: i had got a call from a detective in vandalia and he
told me he had to talk to me so i told him to hold
on that i just got off work and that i would go home
and change and then i will be up there to talk to
him about what he needed to speak to me about Hugh: I had the police arrest me in my house .
They had come into my house and read
me my rights. They then put me into
cuffs and put me in the back of the cop
car when they proceeded to take me to
the Montgomery county jail where I was
booked in Wendy: My 14yr old son called the police on me
claiming I was abusing my daughter (no
bruises) or medics, and because I was drinking
and watching the superbowl, I was arrested
for domestic violence. (the threw a party
when I went to jail) police left them there all
alone period.
JM: What was court like? Please give as many details as you recall. Dan: court was really scary because the fact i didn't
know what the judge was going to say next because
he was mad at me because i had lied to everyone
thinking i could get out and he didn't like it so
i just maned up and told him the truth about
everything
Hugh: First court date you go to video court you
and the judge are on video then you go
to pretrial in front of the judge. The
courtroom has wooden pews and they
call you by your name and case number.
You either get took back into the jail or
fine you or set you up for trial Wendy: Vandalia ohio court and it was quick and
reasonable, only reason I pled to a lesser
charge because I couldnt afford to miss work.
Their court is better than montgomery county
court because it wasn't crowded and the staff
have more respect in how they treat you.
Very clean too.
JM: What were your original charges? What did you end up being convicted of? Dan: original charges was one count rape and then 2
counts attempted rape and i pleaded guilty to the
attempted so then the rape was drooped Hugh: Public intoxication underage
consumption burglary and disorderly
conduct Wendy: Domestic violence. Disorderly conduct charge.
