JM: Tell us about the pre-sentencing process: Randy: The crime I committed was on July 4, 2012. I was
not arrested until July 12, 2012. When the police
arrived at my house, they questioned me and next
thing I know, I am being put in handcuffs and in
the back of a police car. They took me to the
police station, where they filled out whatever
paperwork it is they need, and took my photo along
with fingerprints. From there, they transferred me
to the jail until my court date.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Randy: On July 10, I received text messages from my
victim asking me to explain what had happened. I
replied a few times. On July 11, at about 11:00pm,
police show up at my house and question me. They
admitted that it was them whom I was texting, and
not my victim. They police left, and on the
morning of July 12, I awakened to the police
knocking on my front door. I opened it, they
questioned me a little more, and then arrested me.
JM: What was court like? Please give as many details as you recall. Randy: Court was depressing. I remember sitting there, in
handcuffs and shackles next to my attorney. I
remember seeing my father in the seats. When the
judge came out, I prepared myself for what was
about to happen. When the judge finally sentenced
me, I remember thinking that this is the worst
time in my life. I never expected to be in this
situation. When I looked back, I saw my father
crying. I've never seen him cry prior to that.
JM: What were your original charges? What did you end up being convicted of? Randy: Kidnapping with intent to inflict death, physical
injury or a sex offense, class 2 felony.
Kidnapping by knowingly restraining with intent to
place the victim in apprehension of imminent
physical injury, class 2 felony. Sexual abuse by
intentionally or knowingly engaging in sexual
contact without consent, class 5 felony.
Disorderly conduct with intent to disturb the
peace, class 1 misdemeanor. Assault by intentionally placing victim
in reasonable
apprehension of imminent physical injury, class 2
misdemeanor. Assault by knowingly touching victim
with the intent to injure, insult or provoke that
person, a class 3 misdemeanor. I ended up being
convicted of just the class 5 sexual abuse felony.
