JM: Tell us about the pre-sentencing process: Ben: I was arrested a couple of days after the
robbery. They released me on bond and then I went
to the trail about two or three months later. Katrina: Well, it was like 2 weeks to get into court. You
go to pre-trial then they send you to case
management and then it comes time for the
sentencing so its a long time to get settled on
what's going to happen.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Ben: I got arrested couple days after robbery. They
just found out I was involved and came by. I
didn't know they was coming at all. Katrina: It was a traffic stop, they found drug
paraphernalia. I also didn't have a driver's
license and they ran my name and I had priors. It
was being at the wrong place at the wrong time. l
JM: What was court like? Please give as many details as you recall. Ben: I had a court lawyer who told me I should take
the plea. I didn't want to face down a trial so I
did what he said. I think it worked out better
that way. Katrina: First time you appear its on video court. The
judge takes a look at things to see if they will
hold you over on a bond. I couldn't make the bond
so I stay in until the sentencing.
JM: What were your original charges? What did you end up being convicted of? Ben: The original chardge was armed robbery. I plead
that down to accessory after the fact. Katrina: Possession of drug paraphernalia. Misdemeanor.
