JM: Tell us about the pre-sentencing process: Fred: Didn't really go through much of that. I was
arrested and kept in the jail until my trial. Alfred: A warrent was issued for me on Wendsday, and I
turned myself in that Friday. I was arrested in
Franklin lakes, left there for the day. Told there
bail was 75,000 and I had to get up the deposit
before I could be released, after waiiing the day,
I was then transported to the county jail at 4:00
that night Darryl: lawyer told me I would have to do 6 months in
jail.
He never told me much else. I was not prepared
for it in any way. I knew the law and what I was
facing. He seemed to downplay it as no big deal.
It is a very big deal especially if your not
prepared
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Fred: I was arrested for violating a restraining order
and failure to pay child support. They said I
made a phone call to the person I was supposed
to. Two days later I was arrested at the shelter
where I was staying that was right across the
street from the jail. Alfred: The police had beenlooking for me at my place of
business and at my home. I stayed out till I could
figur out the bail system, The Franklin Lakes police
called me in for an interview, but in the tone I and
nature of the call, I knew better and had an attony
call the FLPD to see what was up. Darryl: I was stopped by police in front of my house. I
was arrested for dwi. I was taken to the police
station. I was asked a bunch of questions. I was
asked to submit to a breath test. I was not given
a chance to call a lawyer until everything was
over.
JM: What was court like? Please give as many details as you recall. Fred: I was really worried about doing some serious
prison time. Alfred: I didn't see the court or Judge till Monday, 3 days
after I was arrested and it was at the jail. I was
read my charges and asked to plead guilty or not
guilty. It was a fast and quick procedure, with no
time or attoney present. They did several people at
the time. Darryl: I hired a lawyer before I went to court. Things
went back and forth for months. I made numerious
court appearances. The judge basically ignored me
and only spoke to my lawyer. The judge did warn
me of the penalties if convicted. My lawyer
handled the rest on my behalf.
JM: What were your original charges? What did you end up being convicted of? Fred: The charges were dropped because the judge didn't
buy the story from the person who made the
complaint. They had no proof I called or text or
anything so it was dimissed. The child support
issues is still being worked out. Alfred: Fraud, theft of srevice, missuse of funds. . Darryl: I had many tickets issued but they were merged
and I was convicted of dwi
