Pre-sentencing

Interview with Sparkie, Craig and Allison

JM: Tell us about the pre-sentencing process:
Sparkie: I got a dwi
Craig: Went to court for driving on the suspended list for a DWI. The judge gave me ten days in MCCI and several fines. After sentencing they took me directly to jail from court.
Allison: While incarcerated I applied for the M.C. Drug Court program with my public defender. Went thru application process and was accepted. I spent 4 months in MCCI. Information was scarce and I relied alot on word of mouth from other inmates. Court procedures took a long time from 1 to the next and unless you have a private/paid lawyer- you know nothing.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Sparkie: got caught on a dwi
Craig: I didn't get arrested when I got caught driving on the suspended list, he issued me a ticket with a court date and let me drive home.
Allison: I was arrested by M.C. Sheriff Officers at my Manalapan, NJ home. They came completely unexpected. The sherrif's were very nice and professiional. They did not really ask questions but were at my home for my arrest only. They were proffessional and nice to my family as well. no complaints

JM: What was court like? Please give as many details as you recall.
Sparkie: Pretty much I had to plead guilty as I was and the judge sentenced me to 3monyhs jail 3 months rehab
Craig: Court was straight forward, I showed up at 9am with my lawyer, they called my name after an hour or so, my lawyer did most of the talking. I pleaded guilty to driving on the suspended list. He gave me the minimum penalty which was ten days in jail approx. a thousand dollars in fines and one year loss of license. After he read the penalties an officer took me off to jail.
Allison: Normal court procedures. I was transported from MCCI, in uniform and handcuffs with others.Court, in between appearences, took a very long time and there was no one to contact for additional information in between. My family was allowed in the court room during my appearences although there was contact allowed.

JM: What were your original charges? What did you end up being convicted of?
Sparkie: DWI and convicted of DWI and driving on rev oked list
Craig: My original charge was DWI. That's what I plead guilty to My license was suspended for 3 months and I was fined about $750.00 in fines. The second charge was driving on the suspended list. I got caught driving two weeks after my licence was suspended.
Allison: Original charges were Prescription Fraud and Uttering. I was charged with same. There, unfortunately, were many indictements.
