JM: Tell us about the pre-sentencing process: Drew: It was a lengthy and tedious process. I have to
admit and it took quite awhile before I realized a
public defender the court appointed attorney was
not ideal for me. I had a few court dates but was
able to be released to a jail diversion program
for a few months
luckily I was blessed. Matt: I arrived on a Friday so I had to wait a few days
for my arraignment on Monday, it took several
hours seeing as they had to process all the
inmates that had come in over the weekend. The
video explained your rights and I said not guilty
and was then housed. The second time I went to
Dona Ana county I was not arraigned or
'pre-sentenced', I had been in Grant County on a
PV Hold and was then extradited, so I got housed
the next day.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Drew: Yes initially when me and Marlena got into an
arguement they the police that is stopped by my
apartment. Although there was a foot chase and I was
maced in handcuffs and later questioned while
intoxicated at Memorial Medical Center. Needless to
say I elaborated on things that didn't help my case. Matt: I was arrested in a stolen Mini-Van, a peace
officer had ran the plates and saw the vehicle was
stolen, radioed it in and followed me, several
police cars then converged on my position and was
pulled over and surrounded by them. After
questioning me and searching the vehicle they
brought me to the station to be questioned by the
Detective, and was then brought to the jail.
JM: What was court like? Please give as many details as you recall. Drew: Court was grueling and when I originally went I
was sentenced to probation. little did I know I
was bound to come back for several violations and
eventually finish my sentence at the Jail. It was
funny thing though when I went to court on my
probatiob violationx stemming from this charge. My
P.O. thought it would all go his way but I had a
payed lawyer first of all and he didn't try rehab
with me at all so I went to Turquoise lodge in
Albuquerque fo
r one month of my sentence. Matt: Court was a very long day. We woke up early and
were brought into booking, where we waited and
were fed breakfast, and then transported to the
court house. We were given a short time to speak
with our public defenders, and then were sent to
sit in the court room. The judge was a very nice
lady, and seemed to be fair. After giving my plea
we were walked back to the holding tank, and after
everyone finished we were transported back. It
took most of the day.
JM: What were your original charges? What did you end up being convicted of? Drew: Assault on an officer, Resisting arrest, and false
imprisonment, and battery. Convicted on the latter
two Matt: My original charges were Receiving or Transferring
Stolen Motor Vehicles, and that is what I was
convicted of.
