JM: Tell us about the pre-sentencing process: Will: I was indicted while I was incarcerated in NJ. I
had to sign an interstate agreement in order to be
transferred from prison in NJ to Orange County NY
on related charges. I was given a public defender,
who tried to convince me to take a 10 year
sentence consecutive to my 5 year sentence in NJ.
The charges in NJ and NY were related. My parents
got me a lawyer and I ended up getting 5 years
concurrent with my sentence in NJ. Before I was
sentenced I was challenging the way I was
presented with my indictment, and I may have been
able to get my charges thrown out due to
mishandling and statutes, etc. But they gave me a
counter-offer at my hearing of 8 years concurrent
and my attorney told me that I could probably get
it down to 5 at my sentencing, etc.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Will: No. I was arrested in NJ at a traffic stop, and a
handgun that I had in my car linked me to a robbery
in NY where that specific handgun was stolen. The
serials numbers matched, and my co-defendant/ex-
girlfriend wrote statements on me, which led to my
indictment and conviction in NY.
JM: What was court like? Please give as many details as you recall. Will: Court was separate from the jail and we had to get
into orange jump suits and cuffs in order to be
brought there. There were different holding cells
that we were broken up into and separated in order
to see different judges. I remember the court
house from when I was a kid, I had been there for
my custody hearing.
JM: What were your original charges? What did you end up being convicted of? Will: 1st degree robbery, a B class felony. 2nd degree
robbery. They had 2 other lesser charges of larceny
from a building, but they dropped them and I pled
out to the 1st degree robbery charge only.
