JM: Tell us about the pre-sentencing process: Johnny: In New York State, inmates are interviewed by the
department of probation to determine an accurate
pre-sentence investigation. Most of the time, the
information probation uses for this report tends
to downgrade the the inmate being evaluated.
Eventually leading to hefty prison sentences
and/or restitution orders. The county judges
follow these pre-sentence investigation reports
very closely.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Johnny: No, I got arrested by a patrolling police officer.
The truck i was riding in had an insurance lapse of
3 days and while we where going to scrap the truck,
it was pulled over. The officer had probable cause
to search the vehicle, consequently he found stolen
property in my possession.
JM: What was court like? Please give as many details as you recall. Johnny: The court process was very slow and painstaking.
Initially, my court proceedings were in a town
court where i appeared every two weeks. After two
months on this system I got to a county court for
a felony hearing. My court appearances became less
frequent the longer i sat in county jail.
Eventually I took a plea after 10 months of being
in jail.
JM: What were your original charges? What did you end up being convicted of? Matt: assault d 2nd Johnny: 2 counts Burglary 3
2 counts CPSP 4
3 counts Burglary 2
along with 7 misdemeanors
Convicted of 1 count Burg 3, 1 Count CPSP 4, 1
count Attempted Burg 2
