JM: Tell us about the pre-sentencing process: Clara: i didnt have this process Carlos: Had a public defender but sat in jail for a year
from the time I was arrested until I went to trial. Oscar: All have the same BS. Takes anywhere from 3 to a
whole day to be screened and sent to an
orientation dorm, that you stay in for a day to
four days, then onto a general population dorm. I
can not answer this any further as I don't know
the procedures for this out come as I had always
been in custody and am not sure what you want to
know else.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Clara: The police came to my house to arrest me. Then took
me to the jail. Carlos: They arrested me and a buddy of mine in Edgewater.
They came in house. They don't care what's going
on. They don't even have to read you your rights
over here. Oscar: Issued a warrant for my different cases. Then
turned myself in. I can not answer this any
further as I don't know the procedures for this
out come as I had always been in custody and am
not sure what you want to know else. this is

JM: What was court like? Please give as many details as you recall. Clara: they had to keep me until sarasota county came to
get me so there was nothing they could do for me
except hold me in volusia county jail for seven
days. Carlos: Wondering how much time I was going to do cause I
was originally charged with 39 felony counts. That
would have been serious time. Oscar: A joke. They all try to force you to plea out,
and the lawyers whether you hire one or have a
public defender defend you all want you to plea
out as they don't like to do work. Then on top
of that the state attorneys all act the same,
assuming you are guilty and just try to give you
as much time as possible, and don't want to drop
charges, even though they know their alleged
victim is lying.
JM: What were your original charges? What did you end up being convicted of? Clara: Check fraud. issuing a worthless check. Carlos: Theft, dealing stolen property, burglary, 39
felonies in all. Oscar: For Volusia county, original: Aggravated Stalking
After Injunction and Burglary with Assault and
Battery. They dropped the assault and battery
charge and had me plea to agg stalking and simple
burglary. Even though they knew I was never
served the injunction nor broke into my ex's
house. Had the emails and text from her inviting
me over. Even stated in the police report all my
communication was non-violent and non-
threatening. Was in fact all responses to her
emails, text, and phone calls.
The other county were grand theft and credit card
fraud stuff.
