JM: Tell us about the pre-sentencing process: Rod: I WAS HELD AT THE SOUTHWEST DETENTION CENTER FOR
APPROX. 3 DAYS BEFORE BEING SEEN BY THE JUDGE. Kerry: well for the pre sentencing they hooked me up with
a public defender and i had to keep going back to
court because the DA and my public defender kept
on continuing the process because he told me thats
kind of how these things are done.So just keep
showing upfor your court dates and so on.I can't
say how long this went on for but it was a while Milton: Well I had A warrant so they came and
picked me up and took me to jail.which I
was in a different county so I had to stay in
there jail for a day then they transferred
her to another jail and finally after two
days they me back up to riverside county James: I was initially booked into West Valley San
Bernardino jail on a misdemeanor but I had a
felony warrant out of Riverside County which
picked me up the next morning. I was transferred
from Robert Presley jail before I was housed to
Southwest jail in southern Riverside County where
I was housed and two days later I was transferred
to the jail in Banning where I spent a few days
and was interviewed for possible house arrest
wearing an ankle bracelet. I was approved and
spent 22 more days on that. Now please refer to
the first question under the "Sentencing" segment.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Rod: NO. I WAS ARRESTED IN LAKE ELSINORE, AND
TRANSPORTED DIRECTLY TO SOUTHWEST JUSTICE
DETENTION CENTER. Kerry: I GOT ARRESTED BECAUSE MY EX WAS FIGHTING WITH ME
PHYSICALLY WELL SHE WAS LIKE KIND OF DRUNK AS
USUAL BUT SHE WAS ACTING RIDICULOUS AND ALL BUT TO
MAKE A LONG STORY SHORT SHE WAS GRABBING ME BY THE
TANK TOP I WAS WEARING AND STRECHTING IT OUT A
COUPLE OF FEET AND WOULD NOT LET GO SO I
DISENGAGED HER HOLD ON ME SHE FELL I LAUGHED SHE
CALLED THE COPS AND I GOT BUSTED Milton: Yes they came to my house to pick me up
for the warrant that I had so they picked
me up and took me to two jails in the
County that I was in and after two days
they took meet up to riverside county to
south west detention center James: I was arrested for petty theft in San Bernardino
County but my warrant out of Riverside County was
for petty theft w/ a prior Penal Code 666.5 That
charge stemmed from a December 2012 arrest in
which I gave the police a false spelling of my
last name and was given a cite release with a
court date and I failed to appear for that, hence
the warrant for my arrest.
JM: What was court like? Please give as many details as you recall. Rod: BRIEF. THE COURTS ARE EXTREMELY CONGESTED. I
WAS SPOKEN TO BRIEFLY IN HOLDING BY A COURT
APPOINTED PUBLIC DEFENDER, THEN BROUGHT UP TO
THE COURTROOM WHERE I WAS SEEN BY THE JUDGE.
THEN RETURNED TO THE SOUTHWEST DETENTION CENTER.
Kerry: A REALLY LONG AND TEDIOUS PROCESS WHICH I CAN'T
SAY THAT I FULLY UNDERSTOOD.YOU SEE I WAS GOING TO
TAKE MY CASE TO TRIAL AT LEAST INTIALLY.mY PUBLIC
DEFENDER SAID THAT HE THOUGHT THAT I HAD A FAIRLY
GOOD CHANCE OF NOT BEING CONVICTED OF THE CHARGES
I HAD AGAINST ME. Milton: Well depending where you go to court they
wake you up at 4:30am to get ready and
then they put you in a holding cell for a
bout 45 min then they take you to transfer
cells you wait there for like an hour and
then you go to court holding cells and wait
until they call youup to your courtroom James: It was basically just meeting outside the
courtroom with a public defender and being told
what the DA was offering and agreeing to it and
then standing in front of the judge to plead
guilty and then having my formal sentencing waived
to a later date at which time I was in court for
an even briefer amount of time and was remanded to
the Sheriff Department to be booked into the
county jail.
JM: What were your original charges? What did you end up being convicted of? Kerry: DOMESTIC VIOLENCE AND POSSESION OF DRUG
PARAPHENALIA.dISTURBING THE PEACE. Milton: Possession of a controlled substance what
I was charged and convicted of
James: PC 666.5 petty theft with a prior. Convicted of
said charged.
