Pre-sentencing

Interview with Kelly, Bill, Leroy, Katrina, Billy, Cory and Emily

JM: Tell us about the pre-sentencing process:
Kelly: I had to wait three days for bond to be set. I had to wait in holding for 12 hours to be placed into a cell area.
Bill: Placed in cuffs after fending off a 6'5" 260lb attacker while he was striking a 5'3" woman in the head. I am 5'6" and 160lbs. I was never asked any questions, many witnesses to a felony assault were told the leave a public place (luxury hotel) or they would be arrested. We 9booth thhe woman and myself) were threatened with physical violence (..."sit the f**k down B***C or I'ma come over there and whip yo A**!!") this happened on approxiamtely 3-4 occassions by one of the 4 officers. We were cuffed and held onsite for 5 hours while i was in need of medical attention. AFter losing consciousness for thhe 3rd time we pleaded for help. I was then transported to Grady Hospital- where i was placed in a cell with 6 other people without food or water for 20+ hours. It smelled of urine and was very cold, without anywhere to sit or lay down. I was then transferred to the jail, where i was placed in a holding cell ( approximately 60 degrees or colder with "half" a (tuxedo) shirt (ripped by assailant). I asked for assistance and was told to sit down and shut up. After staying being forced to stay awake for multiple hours and going through multiple fingerprinting/cell moves/etc.-we were finally placed into a "pod". There was no way for me to know what was happening, when i would get a chance too see an attorney, let alone a judge. it took 2 days to get in front of a judge- and 12 additonal hours AFTER i posted bail to be released.
Leroy: After I was found guilty I was told when and were to report at the the court house from the judge.other then when and were to report the really give the many details the day i showed up for in processing the only a remember was that they i could bring my cigarettes
Katrina: I went to court over 15 times before being sentenced each time I was further noticed you have a first appearance hearing then a bond hearing then you have other court dates for pleas and arraignment sometimes when you go to court you don't even get to see the judge
Billy: Well i had open cases, so each county took their time trying to get me in to court. I haf to set in the county jail for 3 weeks to go to fulton county. We didnt have uniforms so we could wear what we got locked up in.I was shipped to Fulton county to awate going to court. While i was in there a guy hung his self in my cell and i asked to be moved but they said no
Cory: I was given a court appointed attorney, who come and talk to you and tell you what your options are. they usually come the day prior to going to court or the day of court. They don't visit you often. He tell you what you will get if you plea.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Emily: No they came by on their own un announced to me
Kelly: No.
Bill: NEVER.
Leroy: No the police did not stop by my house for questioning the stoppe4d me in my car on the way home. and was taken to jail for Dui and then made bail and given a court date to show for trail and it was then delayed i was given anoter court date and then had the trail found guilty.
Katrina: No I was arrested across the street from the scene of the crime of where my case so called took place I was not asked any questions at all I was placed in handcuffs and placed in the back of the police car I was not marandized nor told what I was charged with
Billy: No the police didnt stop by my house for questioning. I was driving and i got pulled over.The officer pulled me over due to a light out. He ran my license and come to find out that my license was suspended due to a failure to appear for child support.
Cory: I was arrested on the streets for a disturbance with a female acquaintance. We was having a domestic situation, which escalated into my arrest.the female lied to the officer about the situation and recanted her story 2-3 times, but I was still taken in and charged with the both crime.

JM: What was court like? Please give as many details as you recall.
Emily: It was real scary because of all the that were in there and when you have to stand up in front of the judge wondering what they are going to do
Kelly: My court appearance was very brief. I still need to go to court again.
Bill: very good, very efficient.
Leroy: Court to me seemed like a long and drawn out process the delayed the frist court date for what seemed to me like almost a four month period which to me did not seem right and i feel that they should have then just droped the charge just because there not ready.
Katrina: Court was a very long process you have to get up at four o clock in the morning and sit in a very cold holding cell all day long and it makes the process feel bad especially if they further notice you and you don't see the judge it sucks
Billy: Well they wake us up at 4Am to get ready for court. Court does start until 10 or 11 so we are sitting in the holding cell. The judge was ok. She told me my charges and what i had to do to get out. Child support was the worst. No mercy
Cory: the court was long and drawn out. The inmates were brought out at 6 am that morning for court that started at 11:am. you have to wait until every one is seen by the judge, therefore, you are in court all day, until about 7pm. all then is transported back.

JM: What were your original charges? What did you end up being convicted of?
Leroy: My your original charge was that of DUI and was convicted of the same
Katrina: Armed robbery and aggravated assault were my original charges I was convicted of robbery
Billy: Failure to appear for child support, no license no insurance, suspended license and felony theif
Cory: My original charges were aggravated assault and simple battery. I was convicted of both charges.
