Interview with Harley and Ryan

JM: Tell us about the pre-sentencing process:
Harley: It was for a accident that happened on my motorcycle. A woman pulled out in front of me and I crashed the bike. I had witteness and on film and they never charged her with leaving the the accident and I was charged with a d.u.i. and it took a year and a half to go to court on it. In the mean time they threw the evidense out and prosecuted me anyway.
Ryan: I was held in the jail after a drunk driving charge, I bailed out that night and was given a date for a hearing about 2 months from the offense.

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Harley: no they did not I was in Maine medical for three weeks.
Ryan: No, I went from the arrest directly to the jail. It was a drunk driving charge and you are required to go to the jail for processing. Then you can bail out.

JM: What was court like? Please give as many details as you recall.
Harley: It was a kagaroo court no common sense on the juges part.
Ryan: The court hearing was a mess. The young asst. DA had a serious hair across his ass. He didn't get the sentences he asked for in earlier cases involving current inmates. After those cases he was given a chance to negotiate deals with the remaining 6 - 10 people in session that day. He didn't work with anyone or anyone's lawyers from that point on. His sentence was final take it or fight it out later. You could see he was pissed about the earlier cases and would not budge at all for anyone else.

JM: What were your original charges? What did you end up being convicted of?
Ryan: I was charged with OUI (drunk driving) & and leaving the scene of property damage. Both first offenses and no prior run ins with the law. The typical sentence for this is 48 hours in jail, 90 day suspension, and a $500 fine. He was asking for 7 days on the OUI, and 2 days on leaving the scene, 90 day suspension, and $500 fine. After my lawyer tried to make him aware of the standards in this type of case, he was told take it or fight it out later. That's what we are offering. After speaking with my lawyer, I was made aware that we would have to fight him again, and he was not going to budge. So i plead guilty to the charges and got 9 day in knox county,. I set up a suspended sentence for 3 weeks from the day of the plea.
