JM: Tell us about the pre-sentencing process: Erik: I was arrested for possession. Clayton: I work in music and I travel alot. Me and some
friends went up there for a music festival. We
had drugs, and we got busted. There
were Sherriffs at the festival and they
found drugs on us.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Erik: They came to my house and arrested me. They
treated me OK. Clayton: It was kind of funny because I was the only
black guy there. They assumed I was the leader
of the pack, but I wasn't. They had some pretty
preconceived ideas. They didn't rough me up or
nothing but they acted like they might. They
had a holding area at the festival and they took
four of us and put us there before transporting
us to the jail.
JM: What was court like? Please give as many details as you recall. Erik: It was like a 3.5 or 4 month process in court.
I had a public defender during this case. They
represented me the best they could. I was
pretty
much guilty. Clayton: Two of my friends got their charges dismissed.
Me and the other two guys were charged with
felony possession with the intent to sell.We
were charged and read our rights. I had a
public defender.
JM: What were your original charges? What did you end up being convicted of? Erik: I was charged and convicted of possession. Clayton: I was charged with felony possession of drugs. I
was convicted of misdemeanor possession of
drugs. I ended up having to do 8 months. I was
sentenced like a felony but only a misdemeanor
on my record. That was a plea deal. I didn't
go to trial.
