JM: Tell us about the pre-sentencing process: Jim: I went to court on oct 2010. It kept on getting
moved finally by jan 2011 I was sentenced. Jerry: It took about four weeks between eachcourt hearing
so the first hearing was just an arraignment, the
second hearing was postponed and by the third
hearing the prosecutor finally came up with a deal
that was acceptable. By the time a plea agreement
could be reached, I was sentenced to time served
plus 3 months community control
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Jim: no i was stopped for having my brights on. I had
been drinking so when stopped the cop smelled it
and did his field sobriety test. I failed so was
placed under arrest Jerry: No, I violated probation by being arrested for
Boating under the influence. Since I was not driving
the boat and the vessel was anchored, the charge was
dropped to a mi a demeanor offense of reckless
boating. I had to turn myself in for VOP after being
released on bond for the misdemeanor.
JM: What was court like? Please give as many details as you recall. Jim: Court went as smooth as it could i guess no
major diffuculties just took awhile to have my
case called. Jerry: Not in person, on video cameras from a separate
building, not very personal. I had to be shackled
and handcuffed and wear an orange jumpsuit like a
common criminal. I'm sure my appearance had a
negative effect on the prosecutor and the judge. I
didn't even have to be present for the first
hearing.
JM: What were your original charges? What did you end up being convicted of? Jim: DUI and that was the conviction pleady no
contest Jerry: Bui, then dropped to reckless boating
