Interview with Jessica, Joe Smith, Rod, Ben and Jade
JM: Tell us about the pre-sentencing process: Jessica: I WAS ACTUALLY ARRESTED AND BROUGHT RIGHT TO THE
JAIL. WAS PUT IN A HOLDING CELL FOR QUITE A
WHILE AND THEN BROUGHT ELSEWHERE. Joe Smith: After being booked into the jail, you are kept
in a 2 man cell for up to 72 hours (not
including the weekend)where you are locked in
for 23 hours with one blanket, no sheet, no
pillow and no reading material or anything to
occupy your time. After this, then you appear
before the judge and you spend up to 12 hours in
a holding cell with a bunch of other men. Rod: It was for not finishing sts due to foot injury Ben: I went to court and was told that I qualified for
the project remand program. this is a diversion
program that allows people with no previous
criminal history to complete some qualification
and at the end of one year the charge in question
will be lifed from my record. I will need to pay
fine and do some community service Jade: There was a lawyer who calculated my points and
then according to the grid I was sentanced. But
before sencenting I was given a Pre-sentencing
investigastion. Based upon my history of past
criminal report and life style it was then
wriiten up as to weather or not I would commint
a crime again.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Jessica: NO, BUT THEY DID TRY TO LOCATE OTHER PARTIES
INVOLVED. THEY WENT BACK TO MY HOUSE WHILE I WAS
IN THE HOLDING CELL TO TRY AND LOCATE THE OTHER
PARTIES INVOLVED. Joe Smith: No, the police never contacted anyone at my
house. Rod: pulled over unknown there was a warrant because i
had dr.s notes and sts did not want to prolong
any further Ben: I did not have any police stop by my house. i was
actually arrested while I was driving. i was pulled
over once they ran the licence plates of the vehicle
I was driving and came to the conclusion that they
needed to pull me over. they did a felony stop and
I was arrested at that time. Jade: I was stopped while with an aquantence who was
attempting to cash a fraudulent check. Later
after the warrent came about, I turned my self
in. At the time I had no id, but they accepted
me anyway. I had learned that I had a warrent
out through the mail,
JM: What was court like? Please give as many details as you recall. Jessica: COURT APPEARANCE WAS VERY QUICK. VERY
PROFESSIONAL EMPLOYEES, I FELT I WAS TREATED WITH
RESPECT AND FAIRLY. THERE WERE NOT ALOT OF
PEOPLE IN THE COURT ROOM, SO I FELT LIKE I HAD
SOMEWHAT PRIVACY. Joe Smith: You end up spending all day in a holding cell
with a bunch of other men until you finally
appear for a few minutes before the judge and
then they set your bail and your next appearance. Rod: did not go to court just finished sts in jail and
w.house Ben: Court was very slow. I was called from my cell to
go to court right after lunch around noon and I sat
in a room for about 4 hours to go through court to
finally be released. I spend maybe one or two
minutes in actual court to be told I qualify for the
program Jade: It was scary, not knowing what was going to
happen. You are allowed to speak very little
while the fate of my life was in anothers hands.
The Public defender told me the anount of time I
was facing, though he said it was a plea
bargain, there was no bargain..I was sentanced
by the sentancing guidelines.
JM: What were your original charges? What did you end up being convicted of? Ben: My original charges were possession of stolen
property, vehicle Jade: Aiding and Abetting Forgery. And thats what I
plead to.
