JM: Tell us about the pre-sentencing process: Nelson: Well, I was accused of kidnapping a woman
originally. It was turned from kidnapping to a
sex crime... gross sexual imposition. I sat in
there for 5 months. I got a lawyer and tried to
fight the case. I fought it to an extent. Chris: This process is where they have a charge on you
and they are investigating the circumstances
under the charge. They also make sure that you
are not involved in anything else. During this
process they interrogate everyone and determine
what you have done or what they think you have
done. Brad: I was arrested and arraigned within 24 hours after
which my bond was set at $50000 because it was a
robbery case. So needless to say i couldnt post. I then
was appointed a public defender aka a public
pretender. After several weeks i received my indictment
from the grand jury and then arraigned again
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Nelson: The police told me they were going to ask me some
questions. They came to my house and arrested me
and took me to the Reynoldsburg jail. Then I was
booked in at Columbus. The police treated me
decently. They didn't show me a lot of concern or
respect or anything. Chris: In one incident the police arrived at my home
asked me to step outside and then arrested me
and took me to jail.. ANother incident I was at
the DMV paying reinstatement fees and they
arrested me and took me into custody. They try
to ask you the same thing over and over again. Brad: I was interviewed by detectives who basically played me
and coached me into confessing i wasnt aware at the
time that a detective could lie to you about facts on
your case and that was completely legal. Not only is it
completely legal it is promoted and considered an
interviewing technique
JM: What was court like? Please give as many details as you recall. Nelson: If you don't have your own attorney, guys should
try to get some basic knowledge about how court
and the system works. I think something needs to
be provided to the inmates to help them know Chris: Court was lengthy and for the most part you
didnt really understand what was going on. It
was like they traded you for others. What I
mean by this is that you were given a time you
were facing and one guy with a worse charge may
get less time than you. Brad: I was advised not to say anythong in the courtroom by
my public defender. After being approached by the
prosecuter with overwhelming evidence i accepted a
plea deal brokered by my public defender and then
went in front of the judge to see.if he accepted.the deal
proposed by the counsel which he did
JM: What were your original charges? What did you end up being convicted of? Nelson: My original charge was kidnapping. I ended up
pleading to abduction. Chris: Failure to Pay Child Support
