JM: Tell us about the pre-sentencing process: Scott: the p re sentencing process is when the
prosucutor gatherd all off my crimanal history
to determine the lenght of time for my sentence
also gives the judge a back ground history so
they gather up all charges i ever did and they
will use it in court on sentening day Gary: i WAS OUT ON BOND,
I DIDNT HAVE ANY DRUG TESTING TO DO.
I DID NOT HAVE A PROBATION OFFICER FOR PRE-SENTENCING.
I HAD A 50000 DOLLAR BOND IN WHICH I PAID 10% TO
GET OUT OF JAIL THE NEXT DAY AFTER I GOT LOCKED UP.
I ALMOST GOT A LENIENT PROSECUTOR ASIDE FROM THE
ORIGINAL ONE. BUT AT THE LAST MINUTE, THE REGULAR
PROSECUTOR MADE IT IN TIME TO GIVE ME 18 MONTHS.
THE OTHER PROSECUTOR HAD A REPUTATION FOR GOING
EASY ON SENTENCING.
i HAD LAWYERS FROM ALL OVER THE COUNTY MAILING ME
TO TAKE THE CASE. Armando: The Judge reviewed any previous charges that I had
been convicted of as well as the length of time that
has passed since my last conviction. He also
reviewed where the charges actually took place as
far as county and state that the conviction took
place and if he felt I had been truthful.
JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested. Scott: the police never came to my house because i was
arrested on the street.in early 2012 i was
stopped by a task force in front of my friends
residents on a suspision of walking thru the
neiboorhood.after the police stopped me i was
then searched and they found three bags of weed Gary: I SOLD TO A UNDERCOVER OFFICER IN SILVER SPRING ,
MD. I TRAVELED FROM DC TO MONTGOMERY COUNTY MD. I
MET THIS OFFICER ONLINE AT CRAIGSLIST WITH THE
CODE WORD 420 USED. I TURNED HER DOWN AT FIRST
BECAUSE I NEW IF I TRAVELLED OUTSIDE DC THAT THE
CHANCES OF GETTING SET UP WAS HIGH. AND I WAS
RIGHT A COUPLE WEEKS LATER, FINDING MYSELF HARD
PRESSED FOR MONEY. Armando: There were no Police that stopped by my house. I
was actually brought to the Detention Center on a
detainee. I was arrested in Prince George's County,
Maryland and was told that I had an outstanding
warrant from Montgomery County. When I was brought
to Montgomery County Detention Center, I was then
questioned on why I had not returned a rental car.
JM: What was court like? Please give as many details as you recall. Scott: i had to attend several diffent court dates
because when i was first charged i was placed on
pretrail untill my court date.pretrail volated
me and i was sent to the jail untill my court
date.i told my lawer i had a drug problem so he
asked the judge to get me interview for drug
court so i went back an forth to court from the
detention center Gary: i WAS ARRAINED IN ROCKVILLE MD. I WAS TOLD THE
CHARGES AND THE TIME THAT I COULD BE FACING WHICH
WAS UP TO 5 YEARS. i HAD A PAID LAWYER BUT ALL SHE
WANTED WAS A LIGHT SENTENCE NOT TO FIGHT THE
CHARGES. JUST GIVE DETAILS OF PAST AND ASK FOR A
LIGHT SENTENCE.
tHE PROSECUTOR WAS NEW AND YOUNG SO SHE WAS VERY
DIFFICULT TO WORK WITH AND VERY HARSH ON
SENTENCING TO SERIOUS TIME IF SHE COULD.
tHE COURT HAD PEOPLE IN THERE WITH VIOLENT CRIMES
AND CRIMES WITH GUNS AND ONE TEENAGER WAS FACING
30 YEARS FOR A HOME INVASION AND ONE GUY GOT
SENTENCED TO 15 YEARS FOR DRUGS. Armando: For me, I believe the court in Rockville, Maryland
was more efficient as far as getting me in and out.
When I arrived at the courthouse, I was led right to
the holding cell. I spent about 30 minutes in the
holding cell before my case was called. I was then
led into the courtroom by the Sheriff's Deputy with
my hands cuffed behind my back. When I got into the
courtroom, the Judge had the States Attorney read my
Statement of Charges. He then asked me how I plead
and I said guilty. He then sentenced me and I was
taken out of the courtroom and back to the Detention
Center.
JM: What were your original charges? What did you end up being convicted of? Scott: posession of a controlled dangerous substance
being 1000 feet by a school zone
conspircy to disturbute marijuanna Gary: DISTRIBUTION OF MARIJUANA WHICH WAS MY CONVICTION
AS WELL. Armando: My original charges were Theft Over $500.00 and
Unlawful Taking of A Vehicle. I end up being
convicted of Failure To Return a Rental Vehicle.
