Pre-sentencing

Interview with Christian, Robert, Terry, Diana, Gina and Cindy

JM: Tell us about the pre-sentencing process:
Christian: went to pre- sentenance investigations was aske questions about employment,substance abuse,wher i live. who i live with how i pay my rent any mental illness diagnoses it was pretty much a run of the mill questioning took about half an hour was told i would probably have to do random urine test
Chris: I called the public defenders office in downtown Cincinnati to see up an appointment to meet with a public defender.when I went to the appointment the attorney asked me questions pertaining to my arrest and if I had ever been arrested before where I worked and lived and for how long and then they described what would probably happen.
Robert: got a letter in mail that I was being summoned to be in court, which was at the courthouse in downtown Cincinnati, I thought they may give me a warning for being behind on child support but the judge gave me thirty days in jail for being late on my payments
Terry: Pre-sentencing was actually pretty scary, I was charged with assault. I was put on the spot and made a fool of in front of 50 people in the court room. It was very embarrassing to deal with and something I wish to never go through with again Ever. It was a very crushing experience to encounter. .
Diana: I had a probation violation due to failing drug screens and not finishing community service and had to go to court several times. My public defender thought i was for sure going to get a rehab treatment. Finally the judge sentenced me to six months in the hamilton county justice center. (however i didn't serve that long).
Gina: Bad they didn't order one I was sent to Clermont then brought back to the justice center on a pv cause they said I never showed up to probation dept. keep me for 5 more days then got a early release went to sentencing was put on probation and at there office still said I missed my appointment .never had one and if I did they should of came to me
Cindy: if you are out of jail on bond you have to fill out a bunch of forms to have the probation department go through your whole life history and then if you have prior concvictions all of that is on the papers. mostly uou get a chance a probation if you have a job and a family

JM: Did you have police stop by your house for questioning? If not please give us details on how you came to be arrested.
Christian: i was at the cincinnati library main branch on vine and ninth st. three individuals started to herass me and threaten me by telling me they were going to go get some friends and come back and beat my ass, they were also going to put a hit out on me. the police officer came out the library started yelling at me about it i told him fuck you then was areested for disorserly conduct,resisting and obstruction
Chris: No.I was out with friends for a night out at a local club where we were drinking and having fun until wee hours in the morning.we were driving home when I noticed a Hamilton county sheriff do a u turn as we went by.at that moment I floored the gas to see if I could turn off a sent due street and kill my light so he wouldn't see me .But he did lit up his sirens and approach my car asked me to exit I did I was asked for my license didn't have one was taken to the Hamilton county justice center and then release when my wife showed up and given a court date.
Robert: no , like I said I got a summons letter in the mail to appear in court so I went thinking that they would give me a warning but I was wrong, I spent 30 days in jail because I was four weeks behind in support downtown justice center, sucked
Terry: yes the came and listened about the argument. when they came to me, I explain what sparked the argument which was the girl I was seeing put her 5 year old daughter in my bed. I was not comfortable with that at all and told her I was going to seep on the couch. She started yelling at me so I told her to leave. She started yelling more but was in fact getting her things together and she pushed me. I stepped back and she grabbed my house phone an said she had to make a call. I grabbed the phone cord and when to pull the phone and she turned and let go and the phone slightly hit her. From there I was charged with assault.
Diana: I became arrested because I had the probation violation. Finally my probation officer had enough and said "Brittany, you violated probation and are going to have to go to court and probably serve the rest of your jail time". I was very scared but went and got a public defender and went from there.
Gina: I was pulled over cause I made a wrong turn and was in a bad area and the said there reason was cause I was out of place and when they run me I had a warrant after I was pulled over.at that point they took me to the justice center
Cindy: no i got caught scrapping and the company pressed charges even though i was getting the metal out of the garbage can and it said garbage on the outside of the dumpster. they took me to the police station and then took me downtown to the justice center in cincinnati ohio

JM: What was court like? Please give as many details as you recall.
Christian: my attorney was a public defender he did the best he could do although the cop lied to the judge he had a dvd of the incident i had seen befrore being taken to jail but when the court time came the officer said the dvd only showed him putting the cuffs on me
Chris: I showed up for court dressed professional and waited in the court room for my name to be called I was last .I can remember sitting there listening to all the other cases before me.I was really scared as it being my first time in court.when my name was finally called the judge seemed to be a little ticked off .the judge asked what I plead I said no contest and was given 10 days in queens gate.
Robert: well first I had to find the proper courtroom after going through security, and the prosecuter person called my case and I stood up and told the judge I was having problems finding work, and she said that there is plenty of work out there and she sentenced me to thirty days
Terry: Court was scary, i caught a glimpse of the photos the judge was looking at and it showed the bruises and they looked more server than they actually were. Yes I know the phone slightly hit but not as severe as the photos showed. What I think is after the officers took me down stairs she bragged the phone and repeatably hit herself with it to make it look more than it actually happened.
Diana: I was very nervous. I had to wait like an hour until my name got called because my last name starts with an S. Before court started i talked to my public defender about my case and what he thought would happen. WHen i got up to the judges chambers i didn't really talk, the public defender did most of the talking. The results made me cry.
Gina: I was appointed a lawyer that said I would get a or bond which I didn't.i was taken down at least five more times which I only seen the judge once they keep conjuring my case my lawyer would come to holding and tell me my Nextel court day never knew what was going on with my case finally plead guilty so I could get out of jail
Cindy: the judge i had was really nice. he will give every one a chance at probation. plus the jail is so crowded there is no room for the minor charges like misdemenors. they just dont have any place to put every one so you get probation or you can get an early release

JM: What were your original charges? What did you end up being convicted of?
Christian: disorderly conduct,resisting arrest,obstruction of justice
Chris: My original charges were D.U.I.and driving without a license and driving on a suspended license.
Robert: not paying child support on time
Terry: I was convicted of a misdemeanor assault
Diana: My original charges were theft. I was convicted of probation violation.
Gina: Felony 5 theft a nod plea guilty to it after being in jail for almost 5 months
Cindy: misdemenor theft a first degree
